Sample Forms to Obtain Prior Employment Information
from Employees to Implement the Act 32 Provision
about WRS Eligibility

2011 Wisconsin Act 32 changed the WRS (Wisconsin Retirement System) eligibility criteria for new employees “initially employed” by a WRS participating employer on or after July 1, 2011. Those initially employed prior to July 1, 2011, are subject to the old eligibility criteria.

Employers must now determine the date new employees were “initially employed” by a WRS-participating employer. ETF will not have this information if the initial employment was not WRS eligible. Employers will need to rely on the newly hired employee for this information.

A new employee who was initially employed on or after July 1, 2011, who had no prior employment with a participating WRS employer would be evaluated under the new eligibility requirements of:

  • expected to work at least two-thirds of full time per year (defined as 1,200 hours for non-teachers and non-school district educational support personnel, or 880 hours for teachers and school district educational support personnel (not including educational support personnel in technical colleges and other educational institutions));
    and
  • expected to be employed for at least one year (365 consecutive days, 366 in leap year) from employee’s date of hire.

A new employee hired on or after July 1, 2011, who had any employment with a participating WRS employer prior to July 1, 2011, is evaluated under the old eligibility requirements of:

  • expected to work at least one-third of full time per year (defined as 600 hours for non-teachers and non-school district educational support personnel, or 440 hours for teachers and school district educational support personnel (not including educational support personnel for technical colleges and other educational institutions));
    and
  • expected to be employed for at least one year (365 consecutive days, 366 in leap year) from employee’s date of hire.
