Judge Declares Acts 10 and 32 Unconstitutional

On Friday, September 14, a Dane County Circuit Court ruling declared that certain provisions of 2011 Wisconsin Acts 10 and 32 (also known as the Budget Repair and Biennial Budget bills, respectively) are unconstitutional. The majority of the September 14 decision pertains to Chapter 111 of Wisconsin State Statutes, which covers employment relations, including collective bargaining. The Department of Employee Trust Funds (ETF), administrator of the Wisconsin Retirement System, does not have authority over Ch. 111. Nevertheless, ETF is reviewing the decision to determine potential effects on WRS benefit programs and will provide more information to employers and members when it becomes available.
